People often ask what is a Chapter 7 bankruptcy? A Chapter 7 Bankruptcy is a certain kind of bankruptcy generally used by consumers to discharge all of their debts. Do You Qualify for Chapter 7 Bankruptcy? Generally speaking qualification for a Chapter 7 bankruptcy depends on your income and the size of your family. Generally speaking all debts are dischargeable in a Chapter 7 bankruptcy. However there are a few particular areas that the courts say you cannot discharge the debt. That would be areas like student loans, taxes, child support, any judgments you may have against you where you were guilty for fraudulent conduct. Appealing a Court Decision I want to talk for a minute about the appellate process and appealing a court decision. Most people you know when you watch courtroom drama on TV it’s always at the trial level. The witnesses are on the witness stand, the jury’s there. Who wants to watch a TV show about somebody making a legal argument in front of a panel of  judges? That’s what an appeal is. An appeal is nothing more than, “I think this trial judge made a mistake.” Remember, trial judges are lawyers who decided they’d like to be a judge. Sometimes they were good lawyers, sometimes they were not good lawyers. Sometimes they’re experienced lawyers sometimes they’re lawyers who have almost no experience. So there’s nothing infallible about a judge and most judges will candidly tell you that. That they’re just another lawyer who’s trying to do his job. An Appeal is Where You Think a Judge Ruled Incorrectly So an appeal is when you have a situation where you think the judge has ruled incorrectly. Generally you think of white collar crime as things other than robbing a bank, hijacking a car, kidnapping…those are not white collar crimes. White collar crimes generally refer to those things that are involved in some aspect of criminal activity within a business environment: Insider trading, bankruptcy fraud, those types of things are considered white collar crimes. Blue Collar vs. White Collar Crime White collar crimes generally are committed by people who historically wore white collar shirts and coats and ties and were in management. In the past, a white collar crime didn’t include use of a weapon and didn’t necessarily include jail time. And blue collar jobs were described as those where the people wore actual blue work shirts and were generally more in a workforce position. Please note that these are just job descriptions to explain the history of a white collar job vs. a blue collar job and not a judgment of a position. So that’s how historically that white collar crime delineation came about.
